                                      The Estate Department is under the direct control of Sh. Sunil Bhatia, PCS, Additional Commissioner  and is headed by S.O.Estate,  Estate Branch has a strength of Eight Officials including three Senior Assistants.

Introduction and History

The Estate Branch deals with the disposal of commercial/residential property. The Estate Branch is working under the control of Additional Commissioner who has been delegated with the powers of the Estate Officer in respect of property of Municipal Corporation, Chandigarh. The cases are routed through the Tehsildar. There are 1 Section Officer, 2 Senior Assistants, 2 Junior Assistant, 3 Clerks and 1 Steno-typist in the said Branch.

Two complexes namely: I).Motor Market and Commercial Complex. II). 61.21 Acres Development developed by the erstwhile N.A.C. Manimajra have been merged in the Municipal Corporation, Chandigarh w.e.f. 24.5.1992. The residential sites in the 61.21 Acres Development Scheme were allotted through draw of lots besides some commercial SCO Sites in the said scheme. The commercial sites in the Motor Market and Commercial Complex were allotted under the Rehabilitation Scheme to those shopkeepers who were running their business on the Old Ropar Road, Manimajra @ Rs. 150/.- per Sq. Yds. Some Commercial sites were allotted through draw of lots @ Rs. 500/- per Sq. Yds. to the general public. These allotment were made in the year 1977-78 and 1979.

In the year 1980 and thereafter, the commercial properties were allotted through public auctions. All the commercial as well as residential properties were allotted on free hold basis. The building plans of these properties were sanctioned by the Committee consisting of Architect, D.T.P. of the Department of Chief Architect and Town Planning.

 30 Dwelling units in the Modern Housing Complex , Manimajra at the cost of Rs. 90,12,585/- and 21 flats in the 168 flats Scheme in Indira Colony, Manimajra at the cost of Rs. 32,48,849/- were purchased from the Housing Board for allotment to the employees for residential purpose on rental basis.

The land in Pocket No. 1 to 6 acquired by the erstwhile N.A.C. Manimajra was also merged in this Corporation. The Following properties was allotted in these Pockets:-

After the formation of the Municipal Corporation Chandigarh, the following properties were transferred to the Corporation by the Chandigarh Administration to augment its resources :-

   20 S.C.O. Sites and 23 Booths in Sector 9-C
   Hotel Site in Sector 35-B, Chandigarh
   14 Sub-way Shops connecting Sector 17/22, Chandigarh
   136 commercial sites which  were transferred to the Municipal Corporation by Chandigarh Administration in various sectors: 39,36,,32,38 etc.
   13 Sulabh Sauchalayas which have been converted into Commercial Booths totaling 25  nos in Janta and Kumhar Colony, Sector 25, Chd.

Vide notification no. 4628-UTFI(4)-94/10249 dated 27.07.1994 the following four villages were transferred to this Corporation. The shops of these villages were given on rent by the erstwhile Panchayats :

The main functions of the Estate Branch are :

  • to allotment and leaseout the commercial properties;
  • issue of NOC for sale, gift, transfer;
  • Change  of ownership of  properties on the basis of Sale Deed;
  • Gift Deed, Transfer Deed, Will (Regd. Or unregistered)
  • Permission to mortgage in case of leasehold properties;
  • Issue of No Dues Certificate;
  • Recoveries of dues  from allottees;
  • Cancellation of allotment of defaulting allottees;
  • court cases etc. 
  • Recovering of rent from liquor vends falling on the land under the jurisdiction of Municipal Corporation
  • Allotment of cremation ground in Industrial area Phase-I,  Chandigarh.

  • PROCEDURE : The procedure followed by the Estate Branch for various functions :

 

 

1.         Issuance of No Dues Certificate :

 

a)                   Application from the owner/GPA.

b)                   In case application through GPA Notarized copy of GPA and an affidavit that GPA is still valid and executant of GPA is alive.

 

2.         Execution of Lease Deed/Deed of Conveyance :

 

After signing the documents of Lease Deed/Deed of Conveyance of the requisite Stamp Duty before the Branch Assistant alongwith forwarding letter and photographs to be affixed on all the three copies.  If through GPA, then copy of GPA and an affidavit that GPA is still valid and executant of GPA is alive.

 

 

3.         No Objection Certificate for sale :

 

a)                   Application for NOC from the Owner/GPA.

b)                   Specimen signatures of the Owner/GPA duly attested by Magistrate.

c)                   Passport size photograph of owner and purchaser (two each );

d)                   Indemnity Bond of Seller;

e)                   Affidavit from the seller that the property is free from all sorts of court cases, liens, mortgages etc ;

f)                     Liability Affidavit of purchaser;

g)                   In case of GPA, an affidavit that executant of GPA is still alive, has not been revoked and there is no underhand sale and the GPA has not been executed to circumvent the Stamp Duty.

h)                   In those cases in which the owner lives abroad, an affidavit is required that the sale proceeds will not be sent outside India .

i)                     Photocopy of GPA duly attested by Notary;

j)                     Clearance of previous Mortgage/Loan/Redemption Deed;

k)                   Occupation/Completion Certificate issued by the Estate Office, U.T., Chandigarh . (the guidelines regarding grant of extension for construction and occupation certificate is at annexure X);

l)                     Identity proof of the Seller and the purchaser (self attested) in shape of Voter Identity Card/Passport or any other authentic document as a proof of idenity.

 

4.         Transfer on the basis of Sale Deed :

 

a)                   Application for transfer;

b)                   Photocopy of Sale Deed duly notarized;

c)                   Indemnity Bond of Transferee;

d)                   Photocopy of NOC/Permissino to sell already granted by the M.C.

 

5.         Transfer on the basis of the Registered Will :

 

a)                   Application for transfer;

b)                   Photocopy of WILL duly notarized;

c)                   Translated copy of will in English if it is in other language(duly attested by Notary);

d)                   Liability Affidavit of beneficiaries of Will;

e)                   Indemnity Bond of beneficiaries of Will;

f)                     Original Death Certificate;

g)                   Photograph of beneficiaries and deceased allottee;

h)                   Identity proof of Beneficiaries;

i)                     Advertisement is to be given by the beneficiaries in two leading papers(one in hindi and one in English) inviting objection from general public if any.

 

6.         Transfer on the basis of Unregistered Will :

 

a)                   Application for transfer;

b)                   Photocopy of unregistered will duly notarized;

c)                   Translated copy of will in English if it is other language(duly attested by Notary);

d)                   Liability Affidavit of beneficiaries of Will;

e)                   Affidavit of attesting witnesses to the Will alongwith the photograph;

f)                     Original Death Certificate;

g)                   No Objection from all the Legal heirs if the property is to be transferred on one of the legal heirs;

h)                   Photographs of beneficiaries of Will and deceased allottee;

i)                     Indemnity Bond of beneficiaries of Will;

j)                     Identity proof of Beneficiaries;

k)                   Advertisement is to be given by the beneficiaries in two leading papers(one in hindi and one in English) inviting objection from general public if any.

 

7.         Transfer in case of Intestate Death :

 

a)                   Application for transfer from all the legal heirs;

b)                   Original Death Certificate;

c)                   Liability Affidavit of beneficiaries;

d)                   Indemnity Bond of beneficiaries;

e)                   Photograph of beneficiaries and deceased allottee.

f)                     Identity proof of Beneficiaries;

g)                   Advertisement is to be given by the beneficiaries in two leading papers(one in hindi and one in English) inviting objection from general public if any.

 

8.         Transfer on the basis of Registered Will outside family :

 

a)                   Application for transfer;

b)                   Death Certificate in Original;

c)                   Photocopy of Will duly notarized;

d)                   Translated copy of will in English if it is other language(duly attested by Notary);

e)                   Liability Affidavit of beneficiaries of Will;

f)                     Affidavit of attesting witnesses to the Will alongwith the photograph;

g)                   Original Death Certificate;

h)                   Photographs of beneficiaries of Will and deceased allottee;

i)                     Indemnity Bond of beneficiaries of Will;

j)                     Identity proof of Beneficiaries;

k)                   Advertisement is to be given by the beneficiaries in two leading papers(one in hindi and one in English) inviting objection from general public if any.

 

9.         Permission to Mortgage :

 

a)                   Application for mortgage indicating the name of Bank and purpose of loan;

b)                   Affidavit that the property is free from mortgages, encumbrances and litigations;

c)                   Photograph of the applicant;

d)                   Indemnity Bond from the owner;

e)                   NDC/Redemption Deed of the previous loan.

 

 

10.        Conversion from Leasehold to Freehold : 

 

In respect of 600 Independent, Modern Housing Complex, Manimajra (5600 to 6200) :

 

a)                   Prescribed application form for conversion of a residential site from leasehold to freehold can be obtained from the Estate Branch of MCC (Room No. 217) on payment of Rs. 50/-;

b)                   Affidavit on the prescribed performa duly attested by the Executive Magistrate regarding building violations and misuse;

c)                   Demand Draft of Conversion Fee as per prescribed rate (RS. 16,583/- at present);

d)                   Attested copy of the GPA, if any;

e)                   No Objection Certificate from the mortgagee, if the plots stands mortgaged to any Bank, Corporation, Department, Financial Institution etc;

f)                     Occupation Certificate of the Building

g)                   No Dues Certificate issued by the Estate Officer, Chandigarh Housing Board;

h)                   Three recent passport size photographs of the applicant duly attested by the Gazetted Officer;

i)                     Attested copy of allotment letter.

 

 

         Payment of dues is accepted only by Bank Draft in favour of Commissioner, Municipal Corporation, Chandigarh .

 

 

         Note:          The letter no. 45/5/22-UTFI(5)-2009/5931 dated 02.09.2009 issued by the Finance Department addressed to the Estate Officer, U.T., Chandigarh whereby it has been directed that in future, NOC will only be applied by the owner of the property as per record and the same will only be issued to him/her.

 


 

  • AUCTION OF SITES:

The Municipal Corporation auctions site on lease hold basis for 99 years.  The properties are put on auction as per the recommendation of the Finance & Control Committee and the General house of the Corporation.

The property available for disposal is identified. The non-encumbrance certificate from the Engineering Wing of Municipal Corporation, Chandigarh is obtained. The reserve price is fixed by the Finance & Contract Committee. The auction notices are got published in the newspapers. A Committee of the officers of Municipal Corporation, Chandigarh , Presiding Officer and two Councilors nominated by the Mayor is constituted. One Representative from the Chandigarh Administration is also taken as member of the Auction Committee.
